Terms of Service

Hi! These Terms of Service (we’ll just call them the “Terms”) explain how you can use the Sectormentor subscription service (the “Service”), which is brought to you by Vidacycle Ltd (that’s “we”, “us”, or “our”). By using, logging into, or signing up for our Service, you agree to these rules. Think of this as a simple agreement between us.


1. What You Get (The Service)

We’re giving you a subscription to our Sectormentor app. The specifics of your subscription—like how many hectares you can use the app for will be agreed when you sign up. Your subscription includes:

  • Using the app based on your chosen Subscription Level.
  • Email support during your active Subscription Term.
  • Access to view and use your data online.

We work on a basis of trust with our customers. If you ever start using the Service for more than the area you’ve paid for, we trust you to let us know so we can help you update your subscription. Just a heads up: If you buy any physical hardware from us, that’s a separate purchase and isn’t covered by these Terms.


2. Fees and Paying for the Service

Subscription Fees

We ask that you pay for your subscription in advance. Your subscription starts the day we receive your payment, unless we’ve agreed on a different start date with you in writing. Once we have your payment, we’ll activate your account.

Setup Fee

Our setup service covers the customisation and support we give you in the first month to get the system up and running, including an online training session.


3. Subscription Length and Ending the Service

Our 30-Day Happiness Guarantee

If you sign up and decide the Service isn’t right for you, just let us know within 30 days of your start date. If you cancel during that time, we’ll give you a full refund of your Subscription Fees.

Renewals and Cancelling

Your subscription will automatically renew for the same length of time (monthly or yearly) unless you tell us you want to stop.

  • If you want to end your contract, please give us 30 days’ notice before your current subscription period runs out.
  • After that initial 30-day refund period when you first start your subscription, fees you’ve paid in advance are non-refundable.
  • You can always download your data before you leave. We’ll give you clear instructions on the next steps for termination.

4. Your Data: Ownership and Security

Data Ownership

The data you enter into the app is 100% yours. You can download it in a simple format whenever you like.

How We Use It

We promise we will not share your data with anyone outside of Vidacycle without your specific permission. We only use your data internally to make our Service better and to give you great customer support. (NB: If you make use of the Regen Dashboard then you will be able to see where your results sit in relation to the spread of other peoples’ results. Similarly they will be able to see their results in relation to the spread of everyone else’s. This is the one place in the app that we share your data in aggregate. There is no way of knowing anything about the data behind the spread of results you are shown.) For details on how and where we safely store your information, please read our Privacy Policy.

Security (What We Do)

We take security seriously and do everything we can to keep your data safe, including regular backups. However, we can’t be responsible for data loss.


5. The Important Legal Bits

This section just outlines a few necessary things to protect everyone involved:

Our Software is Our Own

The Sectormentor app, software, website design, and all technology used to provide the Service belong to Vidacycle. We grant you a limited, non-exclusive right to use the Service only as described in these Terms. You are not allowed to copy, modify, or resell any part of the Service.

Keeping Expectations Realistic

We do all we can to keep the Service running smoothly all the time, but we can’t promise it will be perfect (no app ever is!). The Service is provided “as is,” meaning we can’t promise it will be error-free or never have downtime.

Force Majeure

Occasionally, things happen that are outside anyone’s control — natural disasters, internet or power outages, government action, and so on. If an event like this stops us delivering the Service, we won’t be in breach of these Terms for as long as it lasts, and we’ll let you know what’s happening as soon as we reasonably can.

Limiting Our Liability

If something goes wrong and you suffer a loss, our total financial responsibility to you will not be more than the total amount you paid us for the Service in the 12 months before the issue occurred. We’re not liable for any indirect or consequential losses — things like loss of profit, loss of business, or loss of data that go beyond the direct cost of the issue itself. Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else that can’t legally be limited or excluded.

Which Rules Apply

This agreement is governed by the laws of England and Wales. If there’s ever a serious legal disagreement, it will be handled exclusively in the courts therein.

If a court decides that any part of these Terms isn’t valid or enforceable, the rest of the Terms will still apply. We’ll treat the affected part as replaced with something as close as possible to the original intention.
 

6. Updating These Terms

We might need to update these Terms from time to time.

  • We can change these Terms when necessary.
  • We will notify you of any significant changes by posting the new Terms on our website and/or by sending you an email.
  • If you keep using the Service after the new Terms are in effect, you’re agreeing to them. If you don’t agree with the changes, you’ll need to cancel your subscription.
